Prenuptial Agreements

These are formal written agreements made before marriage to seek to regulate what would happen financially upon marriage breakdown.

In a landmark decision in 2010, the Supreme Court held that “decisive weight” should be given to pre-nuptial (and post-nuptial) agreements provided the agreement has been entered into by the parties of their own free will, without undue pressure and they have been legally advised about the implications.
